Meeting called to order at 4:08 P.M. under the Massachusetts Wetlands Protection Act and the Wellfleet Environmental Protection Bylaw by Chair Cyndi Moe

SE77-955 Elizabeth Larsen/Gail Ferguson, 112 West Main Street, Assessor’s Map 14, Lot 36: Septic System Upgrade. Ginie Page Moved for approval of Certificate of Compliance; Seconded by John DiBlasio; Passed 5-0.
· Other Business:
Cyndi read a letter from Alison Palmer of 70 Lookout Road. Ms. Palmer is requesting a written response regarding her concern about an Order of Conditions issued to Mr. Robbins for replanting. Emily Beebe will send letter to Ms. Palmer.
Jan Plaue came before the Commissioners to discuss the Sandpit at High Toss Road and bring them up to date on the role the Conservation Trust is playing. The area was surveyed and the property will be divided into two lots. The Conservation Trust provided funding to protect the land; however the Conservation Commission will have the responsibility to set guidelines for the property. It was emphasized the Conservation Trust will not manage this property. The Commissioners agreed a fence of some sort around the wetland area would be valuable.
Paul Banner asked if a memo had been sent to the National Seashore regarding the mapping of trails. Emily Beebe and Chris Bates to complete task.
Emily Beebe provided a brief update on the Herring River and concerns about the existing herring regulations, which need to be amended.
February 4, 2004 meeting minutes were reviewed. Paul Banner Moved to accept the February 4 meeting minutes; Seconded by Ginie; Passed 5-0. The Commissioners stated we should write a letter to Amy Dougherty, thanking her for the work she has done in our community.
Public Hearings:
5:05 Cape Cod National Seashore, Wireless road, Assessor’s Map 30: NOI, Replacement of Atlantic White Cedar Swamp Boardwalk. Harrison Gruman of the National Seashore attended the meeting. The Commissioners made a site visit. Harrison stated the trail was built in the 1960’s and has been repaired on an “as needed basis” but there are concerns with safety issues at this point. The park will abandon 300 feet of the last loop in order to reduce expenses. They do not foresee any issues with the habitat, work will only be done with hand tools, and no materials will be stored on site overnight. Construction will start in late March and be completed by July. The area will not be closed down, they will
keep one section of the boardwalk open for visitors. DEP assigned number SE 77-1028; Natural Heritage has not sent a letter as yet. The Commissioners thanked Harrison for working with them. Emily Beebe will work with Harrison on the conditions of the project and contact Natural Heritage to respond. Ginie Page Moved to continue this hearing until March 17; Seconded by John DeBlasio; Passed 5-0.
5:20 McAuliffe, 40 Way #35 off Briar Lane, Assessor’s Map 13, Parcel 122, NOI, addition to existing dwelling, Cont’d from 2/18/04. Elaine La Chappel represented the owners. DEP assigned number SE77-1025 to this project. The Commissioners made a site visit. Elaine supplied the Commissioners with new plans and narrative. The stairway will be removed to get away from the wetlands. The oil tank will be removed as they are changing to gas. The septic system was upgraded in 1997. A hot tub is proposed to be put on wood decking. Emily Beebe stated her main concern was work being done in the 50 foot filter strip and that the Commission needed the following information: Identify abutters;
restoration plan for property next to owners; revegetation plan for the 50 foot buffer strip (types and location of plants); and movement of the screened in porch to another location out of the 50 foot buffer. The Commission also needs a date when the cut trees will be removed from the abutter’s property. John DiBlasio Moved to continue to April 7, 2004; Seconded by Abby Franklin; Passed 5-0.
The Menegay Realty Trust and Renee Back hearings were requested to be continued to April 7, 2004 by the Engineering firm.
6:00 Peter Brown, 110 Blue Heron Road, Assessor’s Map 42, Parcel 100, NOI, proposed new dwelling. Tim Brady represented the owners. DEP assigned number SE 77-1027. The Commissioners made a site visit. No letter has been received from Natural Heritage as yet. Proposal is for a new dwelling. Tim supplied Commissioners with new plans dated 2/17/04, which show the garage on the other side of the house. The dwelling will be outside of the 50 foot buffer but within the 100 foot buffer zone. The house will consist of four bedrooms, a full foundation with walk out basement under the deck. The property
consists of two parcels paired together. Emily Beebe requested an alternative and analysis narrative. Abby Franklin Moved to continue the hearing to April 7, 2004; Seconded by Paul Banner, Passed 5-0.
Jeff Hughes, the Herring Warden, presented information on the Herring Run. A discussion took place regarding the herring regulations. Present rules allow taking up to 25 fish with a $25 fine for any additional fish taken (regardless of how many). There is concern because other towns have stopped people from taking herring (Harwich, with Brewster planning on changing their regulations). Jeff asked for the Commissioners support of his proposed changes to the regulations: No fish will be taken until May 15, and a $10.00 fine for each fish taken over limit. Abby Franklin Moved to accept new regulations; Seconded by Paul Banner, Passed 5-0. Emily Beebe will contact Board of Selectmen.
The Commission had requested prioritization for the Herring River project through CZM restoration projects. $10,000 was donated to Ducks Unlimited to conduct a survey of the area, which was completed by Slade Associates. CZM is coordinating projects with other agencies.
Jeff passed out an outline of a draft management plan for the Herring run that will include environmental assessment, educational programs, volunteer recruitment, web site, and potential footpaths.
